Milk Quotas Levy 2006/07 – RPA Press Release

No Milk Supplementary Levy for 2006/07

The calculation of the United Kingdom’s milk supplementary levy position for the 2006/07 quota year shows that there is no liability for wholesale or direct sales levy. The UK’s wholesale milk deliveries were under the national wholesale quota by 412 million litres, and total direct sales were 21 million litres under the national direct sales quota level. This provisional outcome is subject to amendment in the light of inspection of purchasers’ and producers’ returns.

Amendments to the Dairy Produce Quotas Regulations (DPQR) 2002

Defra have announced the following changes to the DPQR 2002 with a view to entry into force on 1 April 2004.

70% USAGE RULE
Defra have decided not to introduce a 70% usage rule. This will be reviewed in 2-3 years time when the quotas market has settled from the effects of the European Court of Justice ruling in the Thomsen case.

TRANSFER OF QUOTA WITHOUT LAND
Defra have decided not to introduce new regulations breaking the link between quota and land entirely. They do recognise the need to simplify transfers of quota without land so as of 1 April 2004 it will no longer be necessary to provide individual business cases to justify such transfers. In an attempt to protect tenants who buy quota in their own right, Defra intend to allow them at the end of their tenancy, if they remain producers, to retain quota that they have purchased, in the absence of an agreement with their landlord to the contrary.

REVERSION OF QUOTA TO NON-PRODUCING LANDLORDS
No new legislation. The decision of the EJC in the Thomsen case applies ie such landlords will, at the end of a tenancy, be required to demonstrate that they are intending to take up production or to transfer quota to an active producer as soon as possible.
